BEARD DYE SUBSCRIPTION TERMS & CONDITIONS:

By placing an order, you agree to these terms and agreements.

BEARDdye Subscription Agreement

This Beard Dye Subscription Agreement ("Agreement") is made and entered into on [Date] by and between BEARDdye Inc ("BEARDdye"), and you, the subscriber ("Subscriber").

1. Subscription Services

BEARDdye agrees to provide Subscriber with a regular shipment of beard dye ("Shipment") on a recurring basis according to the chosen subscription ("Plan"). Plans include:

• 1 x Beard Dye Kit per month.
• 2 x Beard Dye Kits per month.

Each beard dye kit includes;

• 1 x dye tube in chosen color(s)
• 1 x developer tube
• 1 x applicator brush
• Instruction booklet
• Gloves
• Wipes

2. Term and Termination

This Agreement will be in effect for the duration of the chosen Plan (e.g., 1 month, 2 months, 3 months) and will automatically renew for another term of the same length unless terminated by either party.

• Subscriber Termination: Subscriber may terminate this Agreement at any time by providing written notice to BEARDdye at least 30 days before the next scheduled billing date.
• BEARDdye Termination: BEARDdye reserves the right to terminate this Agreement for cause, including non-payment or violation of this Agreement.

3. Fees and Payment

Subscriber agrees to pay a monthly subscription fee ("Subscription Fee") based on the chosen Plan. Subscription Fees include the cost of the beard dye kit, shipping, and handling.

• Payment will be made automatically through the chosen payment method (credit card, etc.) on file at the time of subscription.
• BEARDdye reserves the right to adjust the Subscription Fees with 30 days' notice.

4. Shipping and Delivery

• BEARDdye will ship Shipments via post within 1 business days of the order date.
• Subscriber is responsible for providing a valid shipping address.
• BEARDdye is not responsible for lost or damaged packages due to carrier error or incorrect address information.

5. Disclaimer and Warranties

BEARDdye disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

BEARDdye is not responsible for any allergic reactions or adverse effects resulting from the use of the beard dye. Subscriber agrees to conduct a patch test before using the product and assumes all risks associated with its use.

6. Limitation of Liability

BEARDdye's liability to Subscriber under this Agreement is limited to the amount of the Subscription Fee paid by Subscriber. BEARDdye is not liable for any indirect, incidental, consequential, or punitive damages arising out of or related to this Agreement.

7. Intellectual Property

All intellectual property rights associated with the BEARDdye brand, products, and website belong to BEARDdye Inc.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware.

Any dispute arising out of or relating to this Agreement will be settled by binding arbitration in accordance with the rules of the American Arbitration Association.

9. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

10. Amendment

This Agreement may be amended only by a writing signed by both parties.

11. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

12. Notices

All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, sent by certified or registered mail, postage prepaid, return receipt requested, or sent by overnight courier, addressed as follows:

If to BEARDdye:

If to Subscriber:

As per the address and details on their order.

13. Waiver

No waiver of any provision of this Agreement shall be effective unless in writing and signed by the party against whom the waiver is sought to be enforced.

14. Assignment

This Agreement may not be assigned by Subscriber without the prior written consent of BEARDdye.

15. Binding Effect

This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and assigns.

BY SUBSCRIBING TO OUR BEARD DYE PROGRAM, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
